Article I — Introductory provisions and identification of the Landlord

1.1 These General Terms and Conditions (hereinafter the “GTC”) govern the rights and obligations of the contracting parties in the rental of non-residential premises — storage boxes (hereinafter the “Box”) at the Landlord’s facility.

1.3 The Tenant is a natural person or legal entity that concludes a rental agreement with the Landlord on the basis of these GTC. A natural person may be a Tenant only if they are at least 18 years old. A consumer is a natural person who, when concluding and performing the agreement, does not act within the scope of their business activity, employment or profession; Article XV of these GTC additionally applies to consumers.

1.4 These GTC form an integral part of every rental agreement concluded between the Landlord and the Tenant and are issued pursuant to Section 273 of Act No. 513/1991 Coll., the Commercial Code, and Section 53 of Act No. 40/1964 Coll., the Civil Code.

1.5 Legal relations not governed by these GTC are governed by Act No. 116/1990 Coll. on the lease and sublease of non-residential premises, the Civil Code, the Commercial Code and — where the Tenant is a consumer — Act No. 108/2024 Coll. on consumer protection, as amended.

1.6 For the purposes of these GTC: “Order” means the Tenant’s binding request to rent a specific Box, submitted via the form at www.odlozto.com or by e-mail; “Variable Symbol” (VS) means a unique numeric identifier of the Order used to match payments; “PIN” means the numeric access code to the main entrance of the facility and to the Box; “Rental Period” means the period for which the rent has been paid in advance; “Operating Rules” means the rules of movement and conduct in the facility, published in the facility and on the Landlord’s website.

Article II — Subject of the rental

2.1 The subject of the rental is a non-residential space — a lockable storage box of the selected class and number, located in the Landlord’s facility at OC Ondava, Benadova 2, 040 22 Košice.

2.2 Boxes are divided into classes by area and equipment (in particular Mini, Standard, Max, Max Plus, Giga, Individual). The current list of classes, specific Boxes, their area in m² and prices is published at www.odlozto.com and is binding in the version valid on the day the Order is submitted. The specific area and number of the rented Box are stated in the Order confirmation; for Orders under para. 3.3, the specific Box number is determined only as of the start date of the rental.

2.3 The Box is dry, ventilated, lockable and intended exclusively for storing the Tenant’s movable items. The Box is not intended for living, sleeping, carrying on a business open to the public, production, a workshop, provision of services, or for permanent connection of electrical appliances.

2.4 The Landlord does not provide safekeeping of items within the meaning of Section 747 et seq. of the Civil Code. The Landlord does not take over the stored items, does not keep records of them, does not check their content, value or condition, and assumes no duty of custody. The Tenant has exclusive access to the Box and bears full responsibility for the items stored in it.

2.5 Only a Box that is listed as available at the time of the Order can be rented. The Landlord reserves the right, for operational or technical reasons, to offer the Tenant a replacement Box of the same or a higher class at an unchanged price; the Tenant is not obliged to agree to such a replacement and in that case has the right to withdraw from the agreement with a claim to a refund of the proportionate part of the rent.

Article III — Order and conclusion of the agreement

3.1 The rental agreement is concluded at a distance in the following way:

  • a) The Tenant fills in and submits the order form, stating the class and number of the Box, the start date of the rental, the rental term in months, the billing period and their identification and contact details.
  • b) Before submitting the Order, the Tenant confirms by actively ticking the checkbox that they have read and agree to these GTC and that they have read the Privacy Policy.
  • c) Submitting the form is the Tenant’s binding Order. The Landlord promptly sends to the Tenant’s e-mail a confirmation of receipt of the Order with a summary and payment details (amount, IBAN, Variable Symbol, due date).
  • d) The rental agreement is concluded on the day the first rent is credited to the Landlord’s account. The Landlord then provides the Tenant with the PIN under Article VI.

3.2 Submitting an Order does not reserve the Box. The selected Box remains on offer until the first rent is credited and may also be ordered by another interested person; the allocation of the Box is decided by the order in which payments are credited. The Landlord therefore recommends paying the first rent without delay, at the latest on the day before the requested start date of the rental. If the first rent is not credited no later than on the requested start date of the rental, the Order lapses without any further notice.

3.2a Concurrent Orders for the same Box. If the Box has been taken by an earlier-credited payment of another tenant, the Landlord will promptly offer the Tenant another available Box of the same class on unchanged price terms. If no Box of the same class is available, the Landlord will offer a Box of a higher class at the originally agreed price, or — if the Tenant does not accept the offer — will refund the amount paid in full no later than 14 days from the day the Tenant rejected the offer or failed to respond to it within a reasonable time. In such a case the Tenant has no claim to compensation for damages and the Landlord charges no fees.

3.3 Order with a rental start date more than 30 calendar days away. For such an Order, after the first rent is paid the Landlord guarantees the Tenant the Box class and the price according to the price list valid on the day the Order was submitted, but not a specific Box number. The Landlord will assign and notify the specific Box of the selected class no later than the day before the start date of the rental, together with the access PIN.

3.3a If on the start date of the rental under para. 3.3 no Box of the selected class is available, the Landlord will offer the Tenant a Box of a higher class at the originally agreed price. If the Tenant does not accept the offer, or if not even a higher-class Box is available, the Landlord will refund the rent paid in full within 14 days at the latest. The Tenant has no claim to compensation for damages.

3.4 At the Tenant’s request, the rental may also start on the day of the Order or in the following days, including non-working days, if the Box is available and the first rent has been paid; the Landlord will handle such a request according to its operational possibilities.

3.5 The Landlord is entitled to reject an Order, in particular if the requested Box is not available, if the Tenant has provided false, incomplete or implausible data, if the Landlord has an unpaid claim against the Tenant from a previous relationship, or if it has a reasonable suspicion that the Box is to be used in breach of these GTC or legal regulations. If payment has already been made, the Landlord will refund it in full, without delay and within 14 days at the latest, to the account from which it was sent.

3.6 The content of the agreement consists of: (a) the confirmed Order, (b) these GTC in the version effective on the day the Order was submitted, (c) the Privacy Policy and (d) the Operating Rules. In the event of a conflict, an individual written agreement of the parties takes precedence, then the confirmed Order, then these GTC.

3.7 The contracting parties declare that they have full legal capacity and that the data stated in the Order and in subsequent communication are true and complete. The Tenant must promptly notify the Landlord of any change in their identification or contact details.

Article IV — Rental term and its extension

4.1 The rental is concluded for a fixed term of the length stated in the Order, or for an indefinite term if the parties have expressly agreed so. The rental term starts to run on the day stated in the Order confirmation.

4.2 A rental agreed for a fixed term is automatically extended each time by a further Rental Period of the same length, either (a) by payment of the rent for the following period, or (b) by continued use of the Box after the previous period has ended, with the Landlord’s knowledge. The automatic extension does not occur if either party notifies the other, no later than 3 calendar days before the end of the rental term, that it is not interested in an extension.

4.3 The Landlord will as a rule remind the Tenant by e-mail of the approaching end of the Rental Period or of the approaching due date of the next payment. This reminder is a service beyond the contractual obligations; failure to send it, late sending or non-delivery does not release the Tenant from the duty to pay the rent properly and on time and does not affect the consequences of default.

4.4 On the last day of the rental the Tenant must vacate and hand over the Box no later than 20:00, unless the parties agree otherwise.

Article V — Rent, discounts and payment terms

5.1 The rent is determined according to the Landlord’s price list published at www.odlozto.com and valid on the day the Order is submitted; the specific amount is stated in the Order confirmation. The Landlord is not a VAT payer; prices are final.

5.2 The rent includes services connected with the use of the Box to a reasonable extent, in particular operation of the entrance security system, camera surveillance of common areas, lighting of common areas and their regular cleaning. The rent does not include insurance of the stored items.

5.3 A discount for the length of the rental is granted from the monthly rent as follows:

Agreed rental term Discount Part of the price charged
1 – 2 months 0 % 100 %
3 – 5 months 5 % 95 %
6 – 11 months 10 % 90 %
12 or more months 15 % 85 %

5.4 If the Tenant ends the rental before the end of the period for which the discount was granted, for a reason on the Tenant’s side, the Landlord is entitled to additionally charge (claw back) the discount granted for the period already used, up to the amount of the undiscounted rent. This provision does not apply if the rental ended by the Tenant’s withdrawal due to a breach of obligations by the Landlord, nor in the case of a consumer’s withdrawal under Article XV.

5.5 In the Order the Tenant chooses a billing period (1, 3, 6 or 12 months). The rent is always payable in advance, no later than the day before the first day of the Rental Period to which the payment relates. The payment cycle is individual and is based on the start date of the particular Tenant’s rental; it is not tied to the calendar month.

5.6 Payments are made by bank transfer to the Landlord’s account, quoting the assigned Variable Symbol. A payment is deemed made on the day it is credited to the Landlord’s account. Stating an incorrect or missing Variable Symbol may delay the matching of the payment; the Tenant is responsible for stating the payment details correctly. For payments from abroad, bank fees are borne by the party that incurred them (type SHA); if a lower amount is credited to the account, the Tenant must pay the difference.

5.7 The Landlord issues an invoice for the rent paid and, as a rule, sends it to the Tenant electronically to the e-mail stated in the Order; at the Tenant’s request it will always send it. The Landlord does not separately confirm receipt of a payment. The Tenant expressly agrees to the electronic delivery of invoices.

5.8 The Landlord does not charge or collect a deposit or any other security. If the Landlord were to introduce a deposit in the future, it would apply exclusively to agreements concluded after the relevant change to these GTC takes effect and after it is expressly stated in the Order confirmation.

5.9 The Landlord is entitled to adjust the price list unilaterally. A price change takes effect towards an existing Tenant at the earliest from the Rental Period following the expiry of 30 days from notification of the change by e-mail. If the Tenant does not agree with the price change, the Tenant may terminate the rental under Article XIV para. 14.2; until the notice period expires, the original price applies.

Article VI — Handover of the Box, PIN and access to the facility

6.1 The Box is handed over to the Tenant emptied, clean and fit for the agreed use. Handover is carried out by making the Box accessible by means of the PIN; a personal inspection before the start of the rental is possible by arrangement.

6.2 The Landlord sends the PIN to the Tenant by SMS or another electronic message to the phone number stated in the Order, as a rule on the day before the first day of the rental, or earlier if the Tenant so requests and the rent has been paid. The PIN serves both for entry to the facility and to the specific Box.

6.3 The Tenant must protect the PIN from disclosure. The Tenant must not make the PIN available to a third party, except for persons to whom the Tenant knowingly and deliberately entrusted access to their Box. The Tenant is fully responsible for the actions and omissions of such persons as for their own. The Tenant must notify the Landlord without delay, and no later than within 24 hours, of loss or disclosure of the PIN or suspicion of its misuse; the Landlord will then change the PIN without undue delay.

6.4 The Tenant has access to the facility and the Box continuously, 24 hours a day, 7 days a week, unless the Operating Rules or a notice from the Landlord temporarily provide otherwise for reasons of maintenance, breakdown, reconstruction or a security measure. The Landlord will as a rule inform tenants in advance of a planned restriction of access; in the case of a breakdown, without undue delay.

6.5 When leaving, the Tenant must close and properly secure the Box door and the entrance door of the facility, use the exit button to unlock the door, and not stay in the facility without a need connected with the use of the Box.

6.6 After the rental ends, the Landlord deactivates or changes the Tenant’s PIN; from that moment the Tenant loses access to the facility and to the Box.

Article VII — Tenant’s obligations when using the Box

7.1 The Tenant must use the Box properly, with care and exclusively for the agreed purpose, protect it from damage and comply with these GTC, the Operating Rules, generally binding legal regulations including hygiene, safety and fire-protection regulations and technical standards valid in the Slovak Republic, as well as the fire regulations and fire-protection instructions published in the facility.

7.2 Without the Landlord’s prior written consent, the Tenant must not carry out any construction or technical interventions in the Box or in the facility, in particular drilling, anchoring, painting, welding, changing locks, interfering with the electrical installation, ventilation or security system, or placing advertising and information signs.

7.3 The Tenant must not sublet the Box or any part of it or give it into the use of a third party without the Landlord’s prior written consent, nor assign rights and obligations under the agreement to a third party.

7.4 The Tenant must not disturb other tenants or the operator of the building by noise, dust, smoke, gases, vapours, odours, vibrations, light, waste or other emissions exceeding permissible values, and must keep the Box and the common areas orderly and clean.

7.5 The Tenant must remove, at their own expense, waste arising from the Tenant’s activity, including packaging material and items the Tenant is disposing of. Leaving items and waste in the common areas is prohibited.

7.6 The Tenant must promptly notify the Landlord of any damage, defect, fault, leak, presence of pests, mould or any other circumstance that may affect the Box, the facility, or the safety of persons or property, and allow the necessary repairs to be carried out. Repairs of the Box and the facility are carried out by the Landlord; the Tenant is not entitled to carry out repairs themselves or to claim reimbursement of costs unless the parties have agreed otherwise in writing in advance.

7.7 The Tenant must tolerate a restriction of use of the Box due to necessary maintenance, repair or removal of a breakdown without a claim to a rent discount, if the restriction does not last longer than 3 consecutive calendar days. Works that do not restrict the Tenant’s access to the Box (in particular works in common areas, on the entrance or security system or in neighbouring Boxes) must be tolerated by the Tenant without a claim to a rent discount if they do not last longer than 7 consecutive calendar days. In the case of a longer restriction the Tenant is entitled to a proportionate rent discount for the period exceeding the relevant time limit.

Article VIII — Prohibited items and storage limits

8.1 It is prohibited to store in the Box, in particular:

  • flammable liquids and substances, explosives, pyrotechnics, ammunition, weapons and their parts;
  • compressed and liquefied gases, pressure vessels, propane-butane, fuels, oils and lubricants;
  • toxic, corrosive, radioactive, biologically hazardous and health-damaging substances, chemicals and substances endangering groundwater;
  • narcotic and psychotropic substances, precursors, and any goods whose possession or storage is prohibited or subject to a special permit that the Tenant does not hold;
  • items originating from criminal activity, stolen or smuggled items;
  • food, feed and other perishable items; waste of any kind;
  • live animals and plants; human remains and biological material;
  • cash, precious metals and stones, securities, works of art, collections, original documents and other items requiring a special protection regime or an air-conditioned environment.

8.2 Motor vehicles, motorcycles, quad bikes, garden machinery and similar equipment with a combustion engine may be stored only with the Landlord’s prior written consent and only after all fuels and operating fluids have been completely removed and the battery disconnected. Charging any batteries, including batteries of electric vehicles, e-bikes and scooters, is prohibited in the Box and in the entire facility.

8.3 It is prohibited to use or connect in the Box heating appliances, cookers, dryers, generators and any appliances that are not a fixed part of the Box handed over by the Landlord.

8.4 Without the Landlord’s prior written consent, the total value of items stored in one Box must not exceed EUR 3,000. If the Tenant exceeds this limit without consent, the Tenant has no claim against the Landlord to compensation for damages exceeding that amount, even in cases where the Landlord would otherwise be liable.

8.5 The Tenant must observe the maximum floor load of the Box of 400 kg/m² and must not load the walls, partitions or ceiling of the Box. Items must be stored stably so that they cannot fall, damage the structure or block access to technical equipment and escape routes.

8.6 The Landlord does not open Boxes to check their contents. However, if a reasonable suspicion of a breach of this Article arises, the Landlord proceeds under Article X.

Article IX — Facility security and camera system

9.1 The Landlord provides reasonable protection of the facility, in particular PIN-controlled entry, a security system with automatic arming and a camera monitoring system in common areas.

9.2 The camera system monitors entrances to the building, corridors and common areas in front of the Boxes. The camera system does not monitor the interior of individual Boxes or areas where monitoring would unreasonably interfere with privacy. Monitored areas are visibly marked with an information sign placed before entering the monitored area.

9.3 The purpose of monitoring is the protection of the property of the Landlord and of tenants, protection of the safety of persons, and prevention and clarification of unlawful conduct and security incidents. Detailed information on the processing of personal data, including camera recordings, on the legal basis, retention period and the rights of data subjects is set out in the Privacy Policy published at www.odlozto.com.

9.4 The existence of security and camera systems does not create an obligation of the Landlord to guard items stored in the Boxes, does not create liability for their loss or damage and does not replace insurance of the stored items.

Article X — Landlord’s entry into the Box

10.1 The Landlord is entitled to enter the Box:

  • a) after prior notice to the Tenant at least 24 hours in advance, for the purpose of checking the condition of the Box, carrying out maintenance, repair or inspection;
  • b) without prior notice in urgent cases, if immediate damage to property or injury to health is imminent, in the event of a breakdown, fire, leak, release of substances, on the instruction of public authorities, or on reasonable suspicion of storage of prohibited items under Article VIII;
  • c) when exercising the right of retention under Article XIII and when clearing the Box under Article XIV.

10.2 Entry under para. 10.1 points b) and c) is carried out in the presence of at least two persons on the Landlord’s side or an uninvolved witness, or its course is recorded on continuous video. The Landlord prepares a written record of the entry stating the date, time, reason, persons present and the condition found, together with photo documentation. The Landlord keeps the record and provides it to the Tenant on request; when clearing the Box under para. 14.6, the Landlord proceeds under this paragraph.

10.3 If on entry it is found that prohibited items under Article VIII are stored in the Box, the Landlord is entitled to call on the Tenant to remove them without delay and, if there is danger in delay or if the Tenant fails to comply within the set time limit, to arrange for their removal and disposal at the Tenant’s expense and to report the matter to the competent authorities.

Article XI — Liability, insurance and force majeure

11.1 The Landlord is not liable for damage to items stored in the Box, in particular not for their loss, theft, damage, deterioration, flooding, contamination, moisture, mould, rodents or insects, except for damage caused intentionally or by gross negligence of the Landlord. The Landlord does not provide safekeeping or guarding of items (Article II para. 2.4).

11.2 The Landlord holds insurance for its operation, in particular property and liability insurance. This insurance does not replace insurance of the Tenant’s stored items, the Tenant has no direct claim to insurance benefits under it, and its scope and conditions are determined solely by the insurance contract. The Landlord therefore expressly recommends that the Tenant take out their own insurance of the stored items covering storage away from the Tenant’s home or registered office (e.g. an extension of household contents insurance).

11.3 The Tenant is fully liable for damage caused to the Box, to other Boxes, to the equipment and to the common areas of the facility by the Tenant or by persons to whom the Tenant allowed access. Normal wear and tear corresponding to the agreed use is not considered damage. The Tenant must pay the damage within 14 days from receipt of its quantification.

11.4 If the Landlord were obliged to make any payment or perform any obligation towards a third party or a public authority on the Tenant’s behalf as a result of the Tenant’s act or omission (in particular fines, sanctions, disposal costs, compensation for damage), the Tenant must reimburse the Landlord in full for such payment or performance within 14 days from receipt of a request stating the reason.

11.5 Neither party is liable for failure to fulfil an obligation caused by a circumstance excluding liability (force majeure), in particular a natural event, fire, flood, war, terrorist attack, strike, epidemic, decision of a public authority or a long-term interruption of energy supply, if such a circumstance arose independently of its will and it could not prevent it. A party must inform the other party of such a circumstance without delay.

11.6 If the Tenant is not a consumer, the Landlord’s total liability for damage arising in connection with the agreement, regardless of its legal basis, will not exceed the sum of the rent paid by the Tenant for the last 12 months before the damage event. This limitation does not apply to damage caused intentionally or by gross negligence and does not apply towards a consumer.

11.7 If the Tenant is not a consumer, the Tenant is not entitled to withhold or suspend payment of the rent because of an ongoing complaint or an asserted claim for damages, nor to unilaterally set off their claim against the Landlord’s claim.

Article XII — Late payment and sanctions

12.1 In the event of the Tenant’s delay in paying the rent or another monetary claim, the Landlord is entitled to claim default interest in the amount set by law.

12.2 If the Tenant fails to pay the rent or any part of it within 7 calendar days of its due date, the Landlord is, after prior written warning, entitled to block the PIN (change the access code) and prevent the Tenant’s access to the facility and the Box until the debt is paid in full. The Landlord may send the written warning at any time after the rent is due. Blocking access does not in itself affect the duration of the rental or the duty to pay the rent and does not give rise to a claim for a discount.

12.3 If the Tenant carries out an intervention in the Box or facility without the Landlord’s written consent (para. 7.2), the Tenant must restore the original condition at their own expense or pay the Landlord’s costs of restoring the original condition, and pay a contractual penalty of EUR 300.

12.4 If the Tenant breaches the ban on storing items under Article VIII para. 8.1 or 8.2, the Tenant must pay a contractual penalty of EUR 500 and reimburse the costs of removal and disposal of such items.

12.5 If after the rental ends the Tenant does not clear and hand over the Box properly and on time, the Tenant must pay a contractual penalty of EUR 10 for each started day of delay, but not more than EUR 300, and reimburse the Landlord’s actual costs of clearing, removal, storage and disposal of the items. For the period from the end of the rental until the proper handover of the Box, the Tenant must also pay compensation for the use of the Box in the amount of the rent, for each started month.

12.6 Payment of a contractual penalty does not affect the Landlord’s claim to full compensation for damages. The parties declare that the amount of the contractual penalties was agreed having regard to the importance of the secured obligations, is reasonable and is in accordance with good morals and the principles of fair business practice.

Article XIII — Right of retention

13.1 If the Tenant is in delay with payment of the Landlord’s monetary claim for more than 7 calendar days, the Landlord is entitled to retain movable items located in the Box to secure its due claim within the meaning of Section 151s et seq. of the Civil Code, until the claim is satisfied or sufficient security is provided.

13.2 The Landlord will give the Tenant advance written notice of the exercise of the right of retention by e-mail and at the same time by SMS to the phone number stated in the Order, stating the amount of the claim and a period of at least 15 days for its payment. Only after this period has expired without effect is the Landlord entitled to open the Box in the manner under Article X para. 10.2, prepare an inventory and photo documentation of the retained items and store the items. This procedure does not apply to clearing the Box after the rental ends under para. 14.6; the Landlord has the right of retention under para. 13.1 over items stored under para. 14.6.

13.3 The Landlord stores the retained items at the Tenant’s expense. The Tenant will be allowed to take over the items at any time after payment of the amount owed, including storage costs.

13.4 The Landlord is entitled to satisfy its claim from the retained items only in a manner permitted by the legal order of the Slovak Republic, that is, above all on the basis of an enforceable court decision or other enforcement title, or on the basis of a subsequent written agreement with the Tenant. The Landlord is not entitled to sell the retained items on its own without such a title or agreement.

13.5 The provisions of this Article do not deprive a Tenant who is a consumer of the rights granted to them by mandatory provisions of consumer protection law.

Article XIV — End of the rental, clearing and items left behind

14.1 The rental ends: (a) by expiry of the agreed term, unless automatic extension has occurred under Article IV; (b) by written agreement of the parties; (c) by notice of termination; (d) by withdrawal from the agreement.

14.2 Either party may terminate the rental even without giving a reason, with a notice period of 30 days, which starts to run on the day the notice is delivered to the other party. The notice must be in written or electronic form.

14.3 The Landlord is entitled to withdraw from the agreement with immediate effect if: (a) the Tenant is in delay with payment of the rent for more than 7 calendar days despite the written warning under para. 12.2; (b) the Tenant stores prohibited items in the Box under Article VIII; (c) the Tenant gave the Box to a third party without the Landlord’s consent; (d) the Tenant repeatedly or seriously breaches these GTC or the Operating Rules and has not remedied the breach even within a reasonable additional time limit; (e) it is proven that the data provided by the Tenant are false.

14.3a When the rental ends by the Landlord’s withdrawal, the Tenant must, within 7 calendar days of delivery of the withdrawal, contact the Landlord, clear the Box and hand it over under para. 14.5, and pay the outstanding rent and any contractual penalty. The Landlord will, on request, allow the Tenant access to the Box for clearing. The withdrawal is at the same time a written call under para. 14.6 and a call to collect the items under para. 14.7. The Tenant must pay the rent for the whole started Rental Period; rent already paid is not refunded. Payment of the debt after delivery of the withdrawal does not renew the rental; a new rental is possible only by agreement with the Landlord.

14.4 The Tenant is entitled to withdraw from the agreement if the Tenant cannot use the Box properly for more than 10 calendar days for a reason on the Landlord’s side and the Landlord has not remedied the situation even after a written call within a reasonable additional time limit.

14.5 By the end date of the rental, the Tenant must clear and clean the Box and hand it over in a condition corresponding to its condition on takeover, allowing for normal wear and tear, so that the Box is fit for immediate rental to another interested person. Handover is carried out in one of the following ways:

  • a) Electronically: the Tenant sends to info@odlozto.com or to the Landlord’s phone number two photographs — of the interior of the cleared Box and of the closed Box door from the outside. If the Landlord does not notify any deficiencies found within 3 working days, the Box is deemed properly handed over.
  • b) In person: at an agreed inspection date, at which a handover protocol is drawn up.

14.6 If the Tenant does not clear the Box within 7 calendar days after the rental ends, the Landlord is, after a prior written call, entitled to open the Box in the manner under Article X para. 10.2, clear it at the Tenant’s expense, prepare an inventory and photo documentation of the items and store the items at the Tenant’s expense. The Landlord will inform the Tenant of the clearing without undue delay by e-mail, with photo documentation of the items and a call to collect them. The storage costs amount to the monthly rent for the Box, for each started month of storage.

14.7 The Tenant must collect the stored items no later than 30 calendar days from the due date of the rent that the Tenant did not pay (if the rental ended otherwise than by delay in payment, within 30 calendar days from the end of the rental), after payment of the outstanding rent, the costs of clearing and storage and the contractual penalty.

14.8 If the Tenant does not collect the items within the period under para. 14.7, the Landlord will call on the Tenant once more by e-mail and SMS. If the Tenant does not show interest in collecting the items even within 7 calendar days of this call, the items are deemed items that the Tenant has abandoned, and the Landlord is entitled, at the Tenant’s expense, to hand them over for disposal to a person authorised to handle waste; the Landlord prepares a record of the handover with photo documentation. Items of obvious value may be kept in storage longer at the Landlord’s discretion.

14.9 In the event of early termination of the rental by agreement of the parties, if the rent was paid in advance for a longer period, the Landlord will refund to the Tenant the proportionate part of the rent for the unused period. The settlement is made by the method of whole months. The amount is refunded within 14 days of proper handover of the Box by bank transfer to the Tenant’s account; the Landlord issues a corrective document for the refund. The provision of para. 5.4 on charging back the discount is not affected.

14.10 If the Tenant has rented several Boxes, the end of the rental of one Box does not affect the duration of the rental of the other Boxes.

Article XV — Special provisions for consumers

15.1 This Article applies exclusively to a Tenant who is a consumer. The consumer’s rights under this Article cannot be restricted or excluded by contract.

Withdrawal from the agreement within 14 days

15.2 A consumer has the right to withdraw from an agreement concluded at a distance without giving a reason within 14 days from the day the agreement was concluded, under Act No. 108/2024 Coll. on consumer protection.

15.3 Withdrawal may be notified by any unambiguous statement, in particular by e-mail to info@odlozto.com or in writing to the Landlord’s registered office address. The consumer may also use the model withdrawal form, which forms Annex No. 1 to these GTC and is available at www.odlozto.com. The time limit is met if the consumer sends the notification before it expires.

15.4 The Landlord will refund to the consumer all payments received within 14 days of receipt of the notice of withdrawal, by the same method that the consumer used for the payment, unless the parties agree otherwise. The refund is not subject to any further fees.

15.5 Provision of the service before the withdrawal period expires. The Landlord begins to provide the service, that is, makes the Box accessible by sending the PIN, before the 14-day withdrawal period expires only if the consumer expressly requests it. The consumer makes such a request by separately ticking the relevant field in the order form or by an unambiguous written statement sent to the Landlord.

15.6 If the consumer does not request an earlier start of the service, the Landlord makes the Box accessible only after the 14-day period has expired; the start of the rental is correspondingly postponed without a change in price.

15.7 If the consumer requested an earlier start of the service and subsequently withdraws from the agreement within the 14-day period, the consumer must pay the Landlord the proportionate part of the price for the performance actually provided up to the day the notice of withdrawal is delivered. The Landlord will set off this amount when refunding the payment.

15.8 The Landlord hereby expressly informs the consumer that after the service has been fully provided, the consumer loses the right to withdraw from the agreement if the service was provided with the consumer’s prior express consent and the consumer declared that they had been duly informed that by giving this consent they lose the right to withdraw from the agreement once the service has been fully provided.

Complaints

15.9 The consumer is entitled to claim the Landlord’s liability for defects of the service provided, in particular if the consumer could not use the Box for the agreed purpose for a reason on the Landlord’s side. A complaint may be made by e-mail to info@odlozto.com, by phone on +421 902 201 212 or in writing at the Landlord’s registered office address.

15.10 The Landlord will confirm receipt of the complaint without delay. The Landlord will determine the method of handling the complaint immediately, in complex cases within 3 working days at the latest, and in justified cases within 30 days of its submission at the latest. The complaint must be handled within 30 days of its submission at the latest; the Landlord will issue to the consumer a written document on the handling, sent to the consumer’s e-mail.

15.11 In the case of a justified complaint, the consumer has the right in particular to a reasonable discount on the rent for the duration of the defect, to a replacement Box with comparable parameters, or to withdrawal from the agreement if it is a material breach of the agreement.

Alternative dispute resolution

15.12 The consumer has the right to contact the Landlord with a request for remedy if dissatisfied with the way the complaint was handled or if the consumer believes the Landlord has breached their rights. If the Landlord responds to the request negatively or does not respond within 30 days of its sending, the consumer has the right to file a proposal to start alternative dispute resolution under Act No. 391/2015 Coll.

15.13 The competent alternative dispute resolution entity is the Slovak Trade Inspection (Slovenská obchodná inšpekcia), SOI Inspectorate for the Košice Region, with its seat at Vrátna 3, 043 79 Košice, www.soi.sk, or another authorised legal entity registered in the list of alternative dispute resolution entities kept by the Ministry of Economy of the Slovak Republic. The consumer may also use the online dispute resolution platform available at ec.europa.eu/consumers/odr. This does not affect the consumer’s right to turn to the competent court.

15.14 The supervisory authority for compliance with the Landlord’s obligations towards consumers is the Slovak Trade Inspection, SOI Inspectorate for the Košice Region, Vrátna 3, 043 79 Košice.

Article XVI — Protection of personal data

16.1 The Landlord processes the personal data of the Tenant and of persons acting on the Tenant’s behalf to the extent necessary for concluding and performing the rental agreement, for keeping accounts and fulfilling tax obligations, for protecting property and the safety of persons including operation of the camera system, and for asserting and defending legal claims.

16.2 Detailed information on the processing of personal data, on purposes, legal bases, recipients, retention periods, transfers to third countries and the rights of data subjects is set out in the Privacy Policy published at www.odlozto.com, which forms an integral part of the contractual relationship.

Article XVII — Delivery and communication

17.1 The parties have agreed on electronic communication as the preferred method. Documents are delivered by e-mail to the addresses stated in the Order and in Article I of these GTC; such documents have the effect of written form.

17.2 An electronic message is deemed delivered on the working day following its sending to the other party’s last known e-mail address. An SMS is deemed delivered on the day it is sent to the Tenant’s last known phone number. A postal item is deemed delivered on the day of receipt, the day of refusal of receipt, or the last day of the collection period, even if the addressee did not learn of the item.

17.3 Notices with material legal consequences — in particular termination, withdrawal from the agreement, a call before exercise of the right of retention and a call to collect items — are sent by the Landlord by e-mail and at the same time by SMS to the contact details stated in the Order.

17.4 The Tenant must keep their contact details up to date. If the Tenant does not notify a change, delivery is made to the last notified details with the effects of proper delivery.

Article XVIII — Final provisions

18.1 If any provision of these GTC becomes invalid, ineffective or unenforceable, this does not affect the validity of the other provisions; the parties will replace such a provision with a provision with the closest permissible purpose.

18.2 Legal relations between the parties are governed by the legal order of the Slovak Republic. The courts of the Slovak Republic have jurisdiction to resolve disputes; towards a consumer, the mandatory provisions on local jurisdiction and consumer protection apply.

18.3 The Landlord is entitled to change these GTC unilaterally. A change takes effect towards an existing Tenant at the earliest 30 days after its publication at www.odlozto.com and notification to the Tenant by e-mail. If the Tenant does not agree with the change, the Tenant may terminate the rental under para. 14.2; until the notice period expires, the original wording of the GTC applies.

18.4 To an agreement concluded before a change to the GTC takes effect, the version of the GTC effective on the day the Order was submitted applies until its end or until a change takes effect under para. 18.3. An archive of previous versions of the GTC is available on request at info@odlozto.com.

18.5 These GTC (version 2.1) become valid and effective on 01.11.2026 and replace the GTC version 2.0 effective from 09.08.2026. To agreements concluded before that day, the version of the GTC effective on the day the Order was submitted applies under para. 18.4.
